Anyone wishing to set up commercial gaming machines and gaming devices first requires a permit from the competent authority for the commercial operation (see “Further information”).

The devices may only be set up at locations that have been confirmed in writing by the authority responsible for the installation site. You need a confirmation of suitability for each installation site. Please note the suitability of the installation site:

Cash and gaming machines may only be set up in:

• premises of public houses or restaurants in which drinks or prepared food are served for consumption on the spot. This does not apply to drinking establishments, ice cream parlors, dairy parlors or establishments in which the serving of food or beverages plays only a minor role.
• in accommodation establishments,
• in amusement arcades or similar businesses or
• in betting offices of licensed bookmakers, unless sports betting is brokered in the betting office.gaming machines may not be set up in:
• Establishments at public festivals, shooting festivals or similar events, fairs or special markets,
• establishments on sports grounds, in sports halls, dance schools, bathing establishments, sports or youth homes or youth hostels as well as establishments which by their nature or in fact are predominantly frequented by children or young people,
• in catering establishments that do not require a permit (e.g. in restaurants that do not serve alcohol).

By way of derogation, gaming machines may also be set up

• at public festivals, shooting festivals or similar events, fairs or special markets,

In principle, a maximum of two gaming machines may be set up per establishment.

In amusement arcades or similar businesses where no alcoholic beverages are offered for consumption on the premises, a maximum of one gaming device may be installed per twelve square meters of floor space, but no more than eight gaming devices in total.

Procedure

• If you wish to install a gaming machine, you must have the suitability of the installation site confirmed by the competent authority before installation. The application can be submitted online. Please complete the application in full, upload the required documents and submit it.
• The competent authority will check your details and documents and request any missing evidence. You will receive instructions on the further procedure and will be informed of the processing status by e-mail.
• If all requirements are met and the necessary documents have been submitted, you will receive a fee notice and the permit by post. If not all requirements or necessary documents have been met, your application will be rejected and a fee will be charged. In this case, you can read the reason for the rejection in the notification from the responsible office.

Prerequisites

• Suitable place of installation
  
  Gambling equipment may only be installed in locations that have been confirmed in writing by the responsible authority of the place where the equipment is to be installed.
  
  

  • Gambling devices may only be set up in licensed pubs and restaurants, amusement arcades or similar enterprises or betting offices of licensed bookmakers.
  • Gambling devices may also be set up at public festivals, shooting festivals or similar events, fairs or special markets.
• Valid permit for installing gambling equipment with winning opportunities
• Type approval
  
  Only gaming devices with the possibility of winning may be set up if their type of construction has been approved by the Physikalisch-Technische Bundesanstalt.

Documents required

• Application for confirmation of the suitability of the installation location
  
  You must submit an application (you can do this online or use the form) so that you receive confirmation that the installation site is suitable for the gaming device with winning opportunities.
• Ground plan
  
  Floor plan of the premises intended for installation (ideally on a 1:100 scale).
• Proof of valid permission to set up gambling devices with the possibility of winning
  
  Proof to be provided by presenting the permission certificate or a copy thereof

Notes on responsibility

The application for suitability confirmation must be submitted to the Public Order Office that is responsible for the place of installation.
