Money laundering prevention - Provide information as an obligated person

1. Auskunft über alle Geschäftsangelegenheiten und Transaktionen zu erteilen und
2. Unterlagen vorzulegen, die für die Einhaltung der in diesem Gesetz festgelegten Anforderungen von Bedeutung sind.

1. Sie erhalten postalisch eine Aufforderung zur Abgabe von Auskünften über Geschäftsangelegenheiten und Transaktionen und/oder zur Vorlage von entsprechenden Unterlagen.
2. Sie reichen die angeforderten Nachweise bei der zuständigen Aufsichtsbehörde ein.
3. Die Aufsichtsbehörde prüft die Auskünfte und Unterlagen.
4. Sie erhalten eine Mitteilung während und/oder nach Abschluss der Prüfung.

Prerequisites

  You have received a request for documentation from the competent supervisory authority.
• Duty to provide information
  
  Only natural or legal persons or partnerships operating as the following are obliged to provide information:
  

  1. Financial companies
  2. Insurance brokers based in Germany or abroad, provided they maintain branches in Germany
  3. Service providers for companies and for trust assets or trustees, if they provide the services specified in Section 2 (1) No. 13 GwG for third parties
  4. Estate agents
  5. Bookmakers
  6. Commodity dealers, art dealers and art warehouses, provided that the warehousing takes place in duty-free areas
• Authorized representative
  
  The person submitting the documents must be a member of the management level or internal/external money laundering officer of the company.
  The obligated person's legal counsel and/or tax advisor may also make the submission upon presentation of the original power of attorney and designation of the subject matter.

  • If you have any questions, ask the supervisory authority responsible for you which specific documents you have to submit and which way is best for the transmission.
