European lawyer - application for admission in Germany

Für Personen aus Staaten, die Mitglied der Europäischen Union oder der Schweiz sind, gibt es die Möglichkeit, als Europäischer Rechtsanwalt nach dem EuRAG tätig zu sein. Sie dürfen diese Berufsbezeichnung nur nach Aushändigung der Aufnahmeurkunde führen.

Prerequisites

  • Admitted lawyer in the home country
  • Proof of professional liability insurance
    Proof of the conclusion of professional liability insurance pursuant to § 51 BRAO or the submission of a provisional confirmation of cover must be submitted.

Documents required

  • Application for admission under the Act on the Activities of European Lawyers in Germany
    Submit the application with all attachments. The attachments must be also comleted and signed. The attachment Personal data sheet must be submitted with a photo.
  • Proof of nationality
    Proof of nationality (certified copy of a valid identity document) must be submitted.
  • Proof of a certificate from the country of origin
    A certificate shall be submitted by the competent authority in the home Member State stating that the European lawyer belongs to that profession. The certificate shall not be older than three months at the time of its submission. The certificate shall be resubmitted to the Bar annually.
  • Proof of previous convictions
    A certificate from the competent authority in the home country must be submitted stating that there are no known serious professional misconduct, criminal offences or other circumstances which call into question the applicant's suitability for the profession of lawyer.
  • Proof of birth certificate
    A birth certificate must be submitted. In the event of a change of name, documentary proof of the name (marriage certificate/extract from the family register) is also required.
  • Proof of academic degree
    Proof of academic degree, if any, must be submitted.
  • Proof of professional liability insurance
    Proof of the conclusion of professional liability insurance pursuant to § 51 BRAO or the submission of a provisional confirmation of cover shall be submitted. Insurance in the home country meets the legal requirements if it is equivalent to insurance pursuant to § 51 BRAO in terms of conditions and scope of cover. In the case of foreign insurance cover, a certificate from the insurer showing the insurance conditions and scope of cover must be submitted annually after admission.
  • Proof of payment of fees
    Proof of payment of the fee shall be submitted. The fee shall become due upon submission of the application to the Chamber.
