Fireworks - apply for exemption from the ban on the burning of category F2 pyrotechnic articles
If you would like to set off private fireworks outside of New Year's Eve (31 December) and New Year's Day (1 January), you will require a special permit.
You can only obtain this permit for the setting off of fireworks in category F2 (small fireworks or New Year's Eve fireworks).
There must be a special occasion for an exemption to be granted. In justified cases, the competent authority can then authorise exceptions. The authority decides at its own discretion whether and to what extent exceptions are authorised.
You have no legal claim to the granting of an exemption.

Deadlines:
- As a rule, two weeks before the day of burning
- four weeks before the day of the fireworks display (in the case of fireworks in the immediate vicinity of railway installations, airports or federal waterways that are shipping lanes, e.g. Spree, Müggelspree, Havel, etc.).
- You do not need a special licence to set off fireworks in category F1 (small fireworks or youth fireworks) all year round.
- Even with such an exemption licence, private individuals may not set off fireworks in categories F3, F4, stage fireworks in category T2 or other pyrotechnic articles in category P2 (old classes III (medium-sized fireworks), IV (large fireworks) or T (pyrotechnic articles for technical purposes, stage fireworks)!
- The burning of pyrotechnic articles in the immediate vicinity of churches, hospitals, children's and old people's homes and particularly fire-sensitive buildings or facilities is prohibited.
- As the responsible person, you apply for the exemption licence from the local public order office responsible for the place of burning in time in advance.
- The application can be submitted online. Please complete the application in full, upload the required supporting documents and submit them.
- The responsible office will check your details and documents and request any missing evidence. You will receive instructions on the further procedure and will be informed of the processing status by e-mail.
- If all requirements are met and the necessary documents have been submitted, you will receive a fee notice and the exemption permit by post. If not all requirements or necessary documents have been met, your application will be rejected and a fee will be charged. In this case, you can read the reason for the rejection in the notification from the responsible office.

- The responsible person for the burning of small fireworks of category F2 must be at least 18 years old.
- You want to set off small fireworks in category F2 in the period from 2 January to 30 December.
- A special reason is absolutely necessary. An exceptional authorisation can only be granted if this is appropriate in the individual case due to the local circumstances and a careful consideration of the interests of third parties worthy of protection.
